Welcome to 9PSB.
We thank you for using our website and subscribing to our products and services (“Services”). The Services, which include all our online services and platforms accessible through mobile applications, web banking portal, USSD and POS terminals are provided by 9 Payment Service Bank Limited (“9PSB”), whose address is 16 Adeola Odeku Street, Victoria Island, Lagos State, Nigeria.
By using our Services, you are agreeing to the terms and conditions hereinafter appearing. You are required to read these Terms and Conditions of Use (“Terms”, or “Terms and Conditions”) carefully before using the https://9psbwepsiteprod.azurewebsites.net or webpage (collectively “Site”) and our mobile application to access the Services operated by 9PSB (“us”, “we”, or “our”). “Party”, “Parties” or “Us” refers to both you i.e., the Customer and ourselves, or either the Customer or ourselves. The use of the above words or other words in singular, plural or capital letters, should be deemed as reference to the same words as they are interchangeable.
Please note that our Services, being very diverse, we may introduce additional terms or product requirements from time to time, which may then govern the Services and become part of your agreement with us if you use those Services.
1. Notice
Please read these Terms carefully. By accessing our Site and any pages forming a part of it, you agree to be bound by these Terms. Should you not agree to the Terms or any part of it, please do not access this Site or any pages thereof. All our Services may not be available in all geographic locations. Your eligibility for certain Services is subject to review and consent by 9PSB and/or any of its designated subsidiaries, affiliates or agents, as may be advised from time to time.
2. Ownership of Site
This is an agreement between you and 9PSB (or any one or more of its subsidiaries, affiliates or agents, as the case may be (collectively, “9PSB,”). The Terms in this document shall regulate your use of any Site operated by 9PSB. The Site is owned by 9PSB.
These Terms apply to the Sites domiciled at http:/www.9psb.com.ng and any other website, webpage or all sites owned, operated and/or linked thereto by 9PSB.
9PSB offers this Site to you on the basis that you voluntarily accept to abide by the Terms without any change or alteration. Your use of the Site constitutes your unconditional acceptance of its Terms. Fundamental elements of the Terms comprise the DISCLAIMERS OF WARRANTIES AND LIABILITY AND DISPUTE RESOLUTION CLAUSES, the details of which you will find below.
9PSB is at liberty and at its sole discretion to change, modify, add or remove portions of these Terms, at any time it deems fit. You have a continuing responsibility to check these Terms periodically for any changes to them. Where changes have been introduced, and you continue to use the Site, you unconditionally accept and agree to those changes. As long as you comply with the Terms, 9PSB grants you a personal, limited, non-transferable and non-exclusive access to enter and use the Site.
3. Additional Terms
As indicated above, 9PSB reserves the right to introduce additional terms that also regulate use of the Site, including without limitation, specific features of our Services. In the event that any provision expressed in the Terms is at variance with any terms contained within any other Site belonging to 9PSB, these additional terms or conditions will govern and supersede the previously applicable Terms. Use of the Site shall be governed by all applicable federal, state and territorial laws, as amended from time to time. Information or Content that you read on the Site is not designed to be construed as legal or financial advisory of any sort and any form of reliance on them for any other purpose than what has been indicated is exclusively at your own discretion. As may become appropriate, you are encouraged to review your peculiar circumstances and subject them to the expert professional advice of your independent legal and/or tax advisors.
4. Use of Content on Site
The text, visual or user interfaces, pictures, graphics, drawings, logos, trademarks, copyrights, sounds, podcasts, music, and computer code (collectively, “Content”), including but not limited to the configuration, design, order and “get up” of such Content, on the Site is owned, controlled or licensed by or to 9PSB and enjoys the protection of applicable trademark, patent, copyright laws and other intellectual property rights and unfair competition laws. You may find certain other words and symbols which are associated with third-party goods and services; they represent the intellectual property rights of such third-party owners. The use and/or deployment by 9PSB of any such intellectual property rights on the Site does not amount to granting you a license to use the same without written consent or authorization.
We advise that all information and Content on the Site are protected under the intellectual property rights laws of the Federal Republic of Nigeria. You are not permitted to copy, republish, reproduce, download, upload, post, translate, encode, transmit or distribute any part of the Site or Content it bears in any way to any other computer, server, website or other medium for publication or distribution or for any commercial purpose, without 9PSB’s express prior written consent. Any unauthorized use of the Site or the Content it bears in one or more of the ways indicated above is strictly prohibited, and violators may be exposed civil or criminal action.
You are permitted to use the materials or information made available by 9PSB for downloading from the Site provided that you do not deploy the same for non-personal and commercial purposes and make no alterations to the information or material downloaded. The Site has not been designed for use or distribution by any person or entity in any jurisdiction where such use or distribution may be subject to certain restrictions or limitations or is prohibited or unlawful under the domestic laws of those jurisdictions.
5. Use of our Services on the Site
You agree that while using or accessing this Site or the Content it bears for our Services, you will refrain from carrying on any activity that violates or causes a violation of any applicable legislations, rules or regulations including the Terms and Conditions to which you now subscribe. You accept that any misuse of this Site or the Content it bears including deployment of algorithm or other forms of automatic or manual intervention designed to probe, copy, monitor, test, screen, alter or amend any portion of the Site or Content or in any way circumvent, compromise or prejudice the architectural framework of the Site in breach of the stipulations contained in these Terms may be barred by 9PSB or subject to civil and/or criminal liability as the case may be.
You may not impersonate the identity of any user of the Site or Content it bears or undertake any other criminal or prohibited activity, which either infringes the rights of other users, violates the laws of the jurisdiction in which you operate or breaches these Terms. We may send you communications periodically but you have the choice to opt out of those communications.
6. How to open and operate an account
Accounts can be opened via USSD by dialing *990# and following the prompts to register and open an account. Data submitted include DOB (death of birth), Phone number and confirmation/consent to use customer data as validation is done using NIN/BVN or any government approved database for verification. With respect to our mobile application/website, kindly download the 9PSB app or visit our web portal, provide your BVN and upon validation, you may then follow the prompts as indicated above to register and open an account.
7. Electronic Banking Services
9PSB offers electronic banking services and additional terms and conditions may apply to enable you access those services. In offering this service, 9PSB aims to provide inclusive and bespoke banking services.
8. Breach of Terms
9PSB shall be at liberty to disclose any information about you that is in our possession if such information is deemed required for the purpose of investigating a complaint (including, but not limited to, any governmental or law enforcement inquiry) relating to your use of the Site. Such information may also be disclosed where it is pursuant to facilitating the identification of an offending party whose actions are causing injury to or interference with 9PSB’s rights or interests, or the rights or interests of visitors to or users of the Site, including 9PSB’s customers.
In addition, 9PSB is obliged by law to, at all times, disclose any information that is required to comply with any applicable legislation, rule, regulation, directive, legal process or governmental request; or reasonably necessary to enforce these Terms.
You agree that 9PSB may, at its sole discretion, at any time and without prior notice, terminate your access to the Site and/or block your future access to the Site if we ascertain that you have breached or caused a breach of these Terms or the contents of other terms associated with your use of the Site. We may also terminate or suspend your access to the Site or the Content it bears in circumstances, which include but is not limited to (1) lawfully issued request/directive by law enforcement or other government agencies (2) a request by you to delete your own account (3) discontinuance or modification of the Site or occurrence of unforeseen technical challenges.
9. Privacy

You acknowledge that, in your use of the Site or the Content it bears, it is impossible to guarantee completely private and secure internet communications or transmissions. In this connection, you understand that such communications may be liable to being read or intercepted by others, even where measures have been taken to undertake encryption of a particular transmission or communication.
10. Confidentiality of Account Details
The Site has been configured to require the opening of an account to enable you access certain Services or features; this may include setting up a username and password to access an account online. All users are required to be responsible for and to exercise special care in maintaining the confidentiality of their account information, including usernames and passwords, and for any and all activities carried on through their accounts.
You undertake to create commercially reasonable security measures and controls to protect your confidential information. In the event of any breach of those security measures or unauthorized use of your account details, including password or username, you shall notify 9PSB immediately. Nevertheless, being primarily responsible for protecting your account details, you may be held liable for any such breach and the resulting damage or loss incurred by 9PSB.
Conversely, you are not permitted to use anyone else’s username, password or other account details for the purpose of accessing the Site or the Content it bears without the express authorization of the owner of such username, password or other account details. Any damage or loss resulting therefrom shall not be attributable to or borne by 9PSB.
9PSB shall not request you to convey confidential information to her over the internet and you are encouraged to avoid doing so under any guise whatsoever. The consequences of any failure on your part to abide by this provision shall not be borne by 9PSB.
11. Disclaimers
Owing to the nature of online, web-based communications and transmissions, 9PSB is not in a position to commit that activities on the Site or the Content it bears would be error-free or uninterrupted. Where defects occur on the Site, 9PSB would apply its best endeavours to correct them but it cannot provide assurances that specific results would be achieved. 9PSB does not give any warranties as to the accuracy, quality, adequacy or completeness of the Site or of the Content it bears, or any other website or webpage linked to the Site or outcomes that may be obtained from use of the Site or Content it bears, or the other websites or webpages linked thereto. At all times, the Site and the Content it bears shall be deemed to be delivered on an “As-Is” and “As-Available” basis. The information provided thereon is subject to changes from time to time without notification to users. 9PSB cannot guarantee that the documents, pictures, files, podcasts, information, data or other content you download from the Site would be free from features that may be damaging or destructive such as viruses. 9PSB disowns all warranties, express or implied, including warranties as to accuracy, fitness for purpose, merchantability, quiet enjoyment, good title and absence of encumbrances. 9PSB declines liability for the acts, omission, negligence or conduct of any third party concerning or relating to the use of the Site or linked sites. Should you be dissatisfied with the use of the Site or Content it provides, it is fundamental to note that the only remedial measure available to you is to stop using the Site or the Content it bears immediately, as 9PSB shall not be liable for any consequences to you arising from continued use of the Site.
This DISCLAIMER concerns, relates and applies to any form of liability, damage, injury occasioned by any inability, refusal or failure to perform on the part of 9PSB resulting from any act, omission or delay in the operation or management of the Site regardless of the circumstances leading up to it. 9PSB shall be entitled to, at any time and without notice, amend, alter, defer, suspend or terminate operation of or access to the Site, the Content it bears or any portion(s) thereof; amend, suspend or delete any of the Terms applicable to the Site; interrupt the operation of the Site pending the performance of routine or non-routine technical repairs or maintenance activity.
12. Liability is Limited
9PSB is not liable and shall not be held responsible, in any manner whatsoever, for any direct, indirect, general, special, consequential, incidental, punitive or exemplary damages, howsoever described, including without limitation expected/anticipated or lost earnings/profits or any other similar head of claim, arising from any operation, management, use or misuse of the Site or the Content it bears; or website or webpage linked to the Site; or reliance on data or other content procured from the Site, even where the same enjoys encryption or the resulting loss, damage or injury is a reasonably foreseeable outcome of the conduct of 9PSB. In any event, to the extent permitted by law, the total liability of 9PSB for any claims under these Terms, regardless of the circumstances leading up to it, is limited to the amount you may have incurred to use the Services.
13. Use of Site on behalf of companies
Should you subscribe to our Services on behalf of a business, that business accepts and is bound by these Terms. It shall hold harmless and indemnify 9PSB and its affiliates, officers, agents, and employees from any claim or action arising from, concerning or relating to the use or misuse of the Services or violation of these Terms. This includes an obligation to bear all expenses arising from any litigation, arbitration or other form of dispute resolution mechanism.
14. Cookies
Ours is an interactive Site and 9PSB deploys cookies to enable retrieval of user details for each visit. Cookies are used in some areas of the Site to enable their functionality and ease of use for visitors.
15. Force Majeure:
Neither party shall be liable to the other for failure or delay in the performance of their obligations under this Terms if such delay is caused by a force majeure event, which includes but is not limited to war; riots; government action; industrial action; disease, epidemic or pandemic; acts of God PROVIDED ALWAYS that such party gives prompt written notice of such event, the steps being taken or proposed to be taken in relation to such event, and resumes the performance of its/his obligations as soon as reasonably possible after the cessation of such event, the said event not extending beyond thirty (30) days; PROVIDED ALSO that the other party is reasonably satisfied that such event directly impedes the relevant party’s ability to discharge its obligations under these Terms.
16. Governing Law and Dispute Resolution:
These Terms, which constitute an agreement between the Parties, shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria in connection with any disputes arising therefrom.
a. Any dispute arising out of or connected with these Terms shall be resolved through amicable deliberations between the parties within ten (10) days of the declaration of a dispute in writing. In the event that the dispute cannot be amicably resolved through deliberations between the parties, recourse may then be had to mediated settlement by reference to the Lagos Court of Arbitration (LCA) for mediation to be conducted in accordance with the LCA Mediation Rules adopting a sole mediator and to be held in Lagos, Nigeria. The settlement agreement reached by the parties pursuant to the mediation shall be final and binding as soon as same is signed by the parties and their representatives.
b. Where the dispute cannot be resolved within thirty (30) days of appointment of the Mediator, the dispute shall then be submitted to the Nigeria Institute of Chartered Arbitrators (“NICARB”) and shall be resolved under the Rules contained in the first schedule to the Arbitration and Conciliation Act, CAP A18 LFN 2004. The dispute shall be resolved by a sole arbitrator, the appointment of whom shall be by NICARB and in accordance with the said Rules, and the award of the sole arbitrator shall be final and binding on the parties. The seat of the arbitration shall be Lagos, Nigeria and the language to be used in the arbitral proceedings shall be English.
17. Waiver
Failure of either Party to insist upon strict performance of any provision of this or any terms or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any terms. No waiver of any of the provisions of this or any terms shall be effective unless it is expressly stated to be such and signed by both Parties.
